Cloudamize, Inc. (“Cloudamize”) is committed to protecting the privacy of individuals who visit the Cloudamize’s Web Site (each referred to herein as a “Visitor,” “you” or “your”). This Privacy Policy describes Cloudamize’s collection and use of data and information, including Personally Identifiable Information (defined below), collected from or provided by you via Cloudamize’s website, including all associated webpages, at http://www.cloudamize.com (collectively, the “Web Site”).

Except as set forth herein, each Visitor’s personally identifiable information, including, first and last names, email addresses, street addresses and/or telephone numbers (“Personally Identifiable Information”) will not be shared or distributed by Cloudamize with any third party entity or organization. In accessing the Web Site or otherwise providing Cloudamize with Personally Identifiable Information, you understand and agrees that Cloudamize may use your Personally Identifiable Information provided to or collected by Cloudamize subject to the terms of this Privacy Policy.

This Privacy Policy does not govern Cloudamize’s use, processing, storage, maintenance, transmission, collection and/or handling of data, material or information, including Personally Identifiable Information, provided to Cloudamize by you or any of your authorized users in connection with the purchase of any Cloudamize product or service or otherwise collected or acquired by or provided to Cloudamize in connection with Cloudamize’s performance or provision of any products or services to you or any customer. 1. WHAT INFORMATION DOES CLOUDAMIZE COLLECT FROM ITS VISITORS AND WHEN DOES IT DO SO?

When expressing an interest in obtaining additional information about Cloudamize’s products or services, Cloudamize requires you to provide Cloudamize with personal contact information, such as name, company name, address, phone number, and email address, which information includes Personally Identifiable Information (“Required Contact Information”).

As you navigate Cloudamize’s Web Site, Cloudamize may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Web Site (such as the webpages viewed and the links clicked). Additionally, Cloudamize may collect your Personally Identifiable Information when you:

  • Subscribe to an e-mail newsletter;
  • Send Cloudamize or any of its employees an email message; or

You have a choice as to whether to provide Cloudamize with any Personally Identifiable Information. Although you are not required to disclose any Personally Identifiable Information to Cloudamize, Required Contact Information is required to the extent you have any inquiry regarding a Cloudamize product or service.


2. HOW DOES CLOUDAMIZE USE THE INFORMATION THAT IT COLLECTS?

Cloudamize may use information or data that it collects, including your Personally Identifiable Information, for marketing purposes. For example, Cloudamize may use information that you provide to contact you to further discuss your interest or request for information concerning a product or service and to send you information regarding Cloudamize, its affiliates, and its partners, such as information about promotions or events.

Cloudamize uses Web Site Navigational Information to operate and improve the Web Site and may also use Web Site Navigational Information alone or in combination with your Personally Identifiable Information to provide you with personalized information about Cloudamize, its products or services. In addition, Cloudamize may use your Personally Identifiable Information for the following purposes:

3. WHAT WEB SITE NAVIGATIONAL INFORMATION DOES CLOUDAMIZE COLLECT AND HOW IS THIS INFORMATION USED?

This section describes the types of Web Site Navigational Information collected by Cloudamize via the Web Site and how this information may be used.

Cookies

Cloudamize uses cookies to make interactions with the Web Site easy and meaningful. When you visit the Web Site, Cloudamize’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you; they merely recognize your web browser. Unless you choose to identify yourself to Cloudamize, either by responding to a promotional offer, submitting an email, or filling out a web form, you remain anonymous to Cloudamize.

Cloudamize uses cookies that are session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer. Functionality cookies:

Functionality cookies allow the Web Site to remember information you have entered or choices you make (such as your username, language, or your region) and provide enhanced, more personal features. These cookies can also be used to remember changes you have made to text size, fonts and other parts of webpages that you can customize.

Cloudamize uses local shared objects, also known as Flash cookies, to store your preferences or display content based upon what you view on the Web Site to personalize your visit.

Targeting or Advertising cookies:

From time-to-time, Cloudamize engages third parties to track and analyze usage and volume statistical information from Visitors. Cloudamize sometimes uses cookies delivered by third parties to track the performance of Cloudamize advertisements. For example, these cookies remember which browsers have visited the Web Site. The information provided to third parties does not include Personally Identifiable Information, but this information may be re-associated with Personally Identifiable Information by Cloudamize after Cloudamize receives it.

Cloudamize also contracts with third-party advertising networks that collect IP addresses and other information from web beacons (see below) on the Web Site, from emails, and on third-party web sites. Ad networks follow your online activities over time by collecting Web Site Navigational Information through automated means, including through the use of cookies. They use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other web sites. This process also helps Cloudamize manage and track the effectiveness of its marketing efforts.

Third parties, with whom Cloudamize partners to provide certain features on the Web Site or to display advertising based upon your web browsing activity, use Flash cookies to collect and store information. Flash cookies are different from browser cookies because of the amount of, type of, and how data is stored.

Web Beacons:

Cloudamize uses web beacons alone or in conjunction with cookies to compile information about Visitors’ usage of the Web Site and interaction with emails from Cloudamize. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when You viewed a particular Web Site tied to the web beacon, and a description of a web site tied to the web beacon. For example, Cloudamize may place web beacons in marketing emails that notify Cloudamize when you click on a link in the email that directs you to the Web Site. Cloudamize uses web beacons to operate and improve the Web Site and Cloudamize’s email communications.

IP Addresses:

When you visit the Web Site, Cloudamize collects your Internet Protocol (“IP”) addresses to track and aggregate non-Personally Identifiable Information. For example, Cloudamize uses IP addresses to monitor the regions from which Visitors navigate to the Web Site.


4. WHAT PROVISIONS GOVERN A VISITOR’S USE OF PUBLIC FORUMS, REFER A FRIEND, AND CUSTOMER TESTIMONIALS?

Cloudamize may provide bulletin boards, blogs, or chat rooms on the Web Site. Any Personally Identifiable Information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Cloudamize is not responsible AND EXPRESSLY DISCLAIMS ALL LIABILITY surrounding your submission of Personally Identifiable Information in these forums.

Visitors may elect to use Cloudamize’s referral program to inform friends about the Web Site. When using the referral program, Cloudamize requests the friend’s name and email address. Cloudamize will automatically send the friend a one-time email inviting him or her to visit the Web Site. Cloudamize does not store this information.


5. HOW DOES CLOUDAMIZE SHARE THE INFORMATION THAT IT COLLECTS?

Service Providers:

Cloudamize may share your Personally Identifiable Information or other information it acquires from you with its contracted service providers so that these service providers can provide services on its behalf and/or to ensure the quality of information provided. Unless described in this Privacy Policy, Cloudamize does not share, sell, rent, or trade any information with third parties for their promotional purposes.

Business Partners:

From time to time, Cloudamize may partner with other companies to jointly offer products or services. If you specifically express interest in a jointly-offered product or service from Cloudamize, Cloudamize may share your Personally Identifiable Information or other information that it acquires from you to such partner(s). Cloudamize does not control its business partners’ use, storage, maintenance, transmission, processing, handling, collection and/or distribution of such information, and such business partners’ use thereof will be in accordance with such business partners’ own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to specifically express interest in a jointly offered product or service.


6. IS INFORMATION HANDLED OR TRANSFERRED INTERNATIONALLY?

To facilitate Cloudamize’s global operations, Cloudamize may transfer and access your Personally Identifiable Information and other data or information acquired by Cloudamize from around the world, including the United States. This Privacy Policy shall apply even if Cloudamize transfers or accesses such data or information to or in other countries. By providing your Personally Identifiable Information, you acknowledge and agree that your Personally Identifiable Information can be stored for the purposes identified in this Privacy Policy. Cloudamize processes and stores your Personally Identifiable Information in the United States and your Personally Identifiable Information may be stored on servers located outside your residential jurisdiction and which may have less stringent privacy practices than your own. If you provide Cloudamize with your Personally Identifiable Information, such action constitutes your consent to the transfer of your data outside of your country and to the United States.


7. CAN A VISITOR CHANGE HIS OR HER COMMUNICATIONS PREFERENCES?

Cloudamize offers Visitors who provide contact information a means to choose how the Cloudamize uses the information provided. You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of Cloudamize’s marketing emails. Additionally, you may send a request specifying your communications preferences to helpdesk@cloudamize.com.


8. HOW DOES CLOUDAMIZE PROTECT YOUR PERSONALLY IDENTIFIABLE INFORMATION?

Cloudamize uses a combination of firewall barriers, data encryption techniques and authentication procedures, among others, to maintain the security of your online session and to protect your Personally Identifiable Information from unauthorized access and help ensure the appropriate use of your Personally Identifiable Information. These technologies help ensure that your Personally Identifiable Information is safe and secure. Cloudamize hosts its Web Site in a secure server environment that uses firewalls, access control and other advanced technology to prevent interference or access from outside intruders. Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while Cloudamize strives to protect your Personally Identifiable Information, Cloudamize cannot ensure or warrant the security of any information that you transmit to Cloudamize, and you do so at your own risk. Cloudamize DISCLAIMS ANY RESPONSIBILITY OR LIABILITY for a breach of privacy as a result of your negligence.


9. CHANGES TO THIS PRIVACY POLICY

Cloudamize reserves the right to change this Privacy Policy. Cloudamize will provide notification of the material changes to this Privacy Policy through the Web Site at least thirty (30) business days prior to the change taking effect.

Children’s Online Privacy Protection Act

Cloudamize does not knowingly collect any Personally Identifiable Information from children under the age of 13. We recommend that no one under the age of 18 submit Personally Identifiable Information to Cloudamize, and the Web Site is not meant for individuals under the age of 18. If Cloudamize determines that any Personally Identifiable Information that it collected is from an individual under the age of 13, Cloudamize will not maintain this information and will delete same.

HIPAA AND HI-TECH

Cloudamize does not knowingly collect protected health information or medical information of a sensitive nature and its Web Site is not meant for transferring such information. In the event a Visitor shares any protected health information or medical information of any person for any reason whatsoever, SUCH VISITOR EXPRESSLY AGREES TO BE SOLELY LIABLE AND RESPONSIBLE FOR ALL COSTS (INCLUDING ACTUAL ATTORNEY’S FEES AND COSTS), DAMAGES, LOSSES, FEES, EXPENSES, CLAIMS, CAUSES OF ACTION, JUDGMENTS, AND/OR SETTLEMENTS INCURRED BY CLOUDAMIZE AS A RESULT OF SUCH VISITOR’S DISCLOSURE OF SUCH INFORMATION. To the extent Cloudamize determines that it has collected any protected health information or medical information of a sensitive nature, it will not maintain this information and will delete same.

CONFLICT OF TERMS

To the extent the terms or conditions of this Privacy Policy conflict with the Terms of Service, the Terms of Service shall control.
